Primary and noncontributory endorsement, explained
Primary and noncontributory wording means the subcontractor’s policy pays first for a covered claim and does not ask your own policy to share the loss. Contractors ask for it so a sub’s claim hits the sub’s insurance before their own. It comes from a policy endorsement, not from the certificate, so ask for the form.

Primary means the policy responds first, up to its limit. Excess means it responds only after other insurance is used up. When two policies could both respond, the order matters. Without the wording, your own policy may be asked to contribute.
What noncontributory adds
Noncontributory means the sub’s insurer will not ask your insurer to share the loss. Together, primary and noncontributory tell the sub’s insurer: pay first and do not look to the additional insured’s own policy.
Why GCs require it
- Keeps a sub-caused claim off your loss record.
- Protects your deductibles and premiums.
- Is often a requirement from owners and lenders on larger projects.
How to check it
- Look for the wording in the description box of the certificate. It is a hint, not proof.
- Ask for the endorsement form from the sub’s policy.
- Confirm that it applies to you as an additional insured and to the right operations.
- Put the requirement in your subcontract insurance clause.
Primary and noncontributory is often paired with a waiver of subrogation. See what a waiver of subrogation is. State law can limit what a contract may require, so check your state page under COI tracking by state.
Not legal or insurance advice. This is general information. Your contract, your state and your policy decide what applies to you. Ask your broker or attorney.
